Title: Automobiles and Light-Duty Trucks New Source Performance Standards Review 
Abstract:

This action will address the agency’s review of the New Source Performance Standards (NSPS) for Automobile and Light-Duty Truck Surface Coating Operations. The Automobile and Light- Duty Truck Surface Coating Operations NSPS, 40 CFR part 60, subpart MM, was promulgated pursuant to section 111(b) of the Clean Air Act (CAA) on December 24, 1980. The NSPS established standards of performance in the form of emission limitations based on the best system of emission reductions (BSER) (taking into account the cost of achieving such reduction and any nonair quality health and environmental impact and energy requirements). The pollutants emitted from the affected sources include volatile organic compounds. This action will implement the review requirements of CAA section 111(b)(1)(B). CAA section 111(b)(1)(B) requires the EPA to review, and if appropriate, revise the standards of performance based on the BSER, no less often than every 8 years. Pursuant to the Our Children’s Earth consent decree, the EPA was obligated to propose this action by May 1, 2022, and is obligated to finalize this action by May 1, 2023. The EPA proposed action signature date was April 29, 2022, and proposed rule published in the Federal Register on May 18, 2022 at 87 FR 30141.
