Title: ●Proposed Amendments to the FDIC's Section 19 Regulations | |
Abstract:
Section 19 of the FDI Act (12 U.S.C. 1829) requires persons with certain covered criminal offenses on their records to obtain prior written consent from the appropriate FBA before participating in the conduct of the affairs of any depository institution. The FDIC is requesting comments on proposed amendments to its section 19 regulations under 12 CFR part 303, subpart L. The amendments would prospectively require an individual with a covered offense based on misconduct committed against an IDI or insured credit union to file a section 19 application with the FDIC prior to participating in the conduct of the affairs of an IDI, unless such a covered offense has been completely expunged. (The FDIC’s regulations currently treat all expungements as complete expungements.) The proposed amendments are intended to reduce risk to the financial system and protect the DIF. |
