The Office of Personnel Management is proposing to delete sections 831 subpart M (5 CFR 1301 to 1309), subpart N (5 CFR 1401 to 1407), subpart R (5 CFR 1801 to 1808), and part 845; amend 5 CFR part 835 to include updated regulations to administer the debt collection activities under the Civil Service Retirement System and the Federal Employees Retirement System. The current regulations reference title IV, which has been replaced by title 31, and do not incorporate any of the changes that were set forth by the Debt Collection Improvement Act of 1996. As a result, OPM needs to update its debt collection regulations to incorporate these statutory changes.  OPM also needs to amend its regulations to ensure they reflect precedential decisions that affect the debt collection regulations since the last update in 1995.
