Title: Institutional Costs Contribution Requirement for Competitive Products 
Abstract:

This rulemaking is a continuation of Docket No. RM2017-1, which the Commission established to determine the institutional costs contribution requirement for competitive products.  39 U.S.C. 3633(a)(3) requires the Commission to promulgate regulations to ensure that competitive products collectively cover an appropriate share of the Postal Service's institutional costs. 39 U.S.C. 3633(b) requires the Commission to conduct a review every five years to determine whether the institutional costs contribution requirement should be retained in its current form, modified, or eliminated.

The Commission issued final rules relating to the institutional costs contribution requirement for competitive products, which were appealed to the Court of Appeals for the District of Columbia Circuit. The court remanded the rules for further consideration.  The Commission issued a supplemental Notice of Proposed Rulemaking to address the issues identified by the court.
