Abstract:
Bureau of Industry and Security (BIS), which oversees implementation of EO 13873, proposes a framework for how BIS will identify classes of ICTS transactions, as well as the types of authorizations required by U.S. persons or foreign persons to engage in ICTS transactions within a specific class. The rule proposes further that when identifying an ICTS class, BIS will also identify those end users and end uses of ICTS provided by certain foreign parties that are prohibited, that require prior authorization from BIS before an ICTS transaction can occur for a given class, and those ICTS transactions within a class that may occur without authorization. BIS believes that identifying classes of ICTS transactions, as well as identifying parties to transactions that are prohibited or require authorization to engage in ICTS transactions within a class based on the end use or end user of that ICTS, will help clarify to industry and foreign parties the ICTS rules. The classes will also serve to provide industry and others seeking to engage in ICTS transactions with information about whether such transaction might pose an undue or unacceptable risk. Additionally, the class-based rules will be easier for both the Department as well as the public to administer by providing clear expectations for ICTS end users, which in turn will help protect U.S. national security. |
