Title: Revisions to the Lists of Reformulated Gasoline Covered Areas | |
Abstract: To reduce vehicle emissions of ozone-forming and toxic air pollutants, the Clean Air Act (CAA) directs EPA to issue regulations that specify how gasoline can be reformulated so as to result in significant reductions of such air pollutants in relation to the 1990 baseline fuel and to require the use of such reformulated gasoline (RFG) in certain "covered" areas (certain nonattainment areas) as prescribed by the CAA. The CAA also requires that RFG be sold in any area that is reclassified as Severe for any ozone national ambient air quality standard (NAAQS). EPA recently reclassified several areas as Severe nonattainment areas for the 2008 ozone NAAQS. These areas include Dallas-Fort Worth, TX, Denver-Boulder-Greeley-Ft. Collins-Loveland, CO and Kern County (Eastern Kern), CA. In this final action, EPA revised its regulations at 40 CFR 1090.285(b) and (c) to indicate that these three areas are required to sell RFG beginning one year after the effective date of their reclassification as Severe for the 2008 ozone NAAQS. Pursuant to our regulations at 40 CFR 1090.290(e), we finalized a rule without prior proposal because the revisions to 40 CFR 1090.285(b) and (c) merely reflect changes required due to the reclassification of the areas as Severe nonattainment areas for the 2008 ozone NAAQS. | |
