Abstract:
The Commission directed staff to review the Consumer Product Labeling Program at 16 CFR 1107.30. Section 14 of the Consumer Product Safety Act, 15 U.S.C. 2063, states that the Commission may require the use and prescribe the form and content of labels for consumer products that are subject to a consumer product safety rule. It further states that no advertisement or label or packaging may contain a reference to a consumer product safety rule or voluntary standard unless the product conforms with the applicable rule or standard. Failure to comply with any requirement of section 14 is a prohibited act pursuant to section 19 of the Consumer Product Safety Act, 15 U.S.C. 2068. Staff is drafting a notice of proposed rulemaking to update 16 CFR 1107.30, that will be submitted to the Commission in fiscal year 2023. |
