Title: HAVANA Act Implementation | |
Abstract:
This rule provides DoD's implementation of Public Law 117-46, "Helping American Victims Afflicted by Neurological Attacks (HAVANA) Act of 2021." The Act provides authority for heads of agencies to provide payments to certain individuals who have incurred qualifying injuries to the brain. This rule is being published as a direct final rule and is effective immediately upon publication since it relates to the provision of the HAVANA Act benefits and thus is exempt from the procedural requirements of the Administrative Procedure Act. See 5 U.S.C. 553(a)(2). It is in the public interest for this rule to become effective as soon as practicable to ensure expeditious payments. However, the Department is seeking comment from interested persons on the provisions of this rule and will consider all relevant comments in any subsequent rulemaking. |
