Title: Privacy Act Exempt Record System for NIH Police Records; Implementation | |
Abstract:
This proposed rule would establish a new system of records (SOR), NIH Police Records, within which to store criminal and non-criminal law enforcement investigatory material maintained by the NIH Division of Police. This SOR needs to be exempted from access by individual record subjects and from other requirements of the Privacy Act (5 U.S.C. 552a) which, if complied with, would jeopardize the integrity of law enforcement proceedings and records compiled in the course of NIH Division of Police activities, disclose investigative techniques, and disclose the identity of confidential sources involved in those activities. Such material is eligible for exemption based on 5 U.S.C. 552a(j)(2) and (k)(2), via rulemaking amending 45 CFR 5b.11 to identify the NIH Police Records as an exempt system of records. |
