Title: Regulatory Updates to Implement Policy – National Instant Criminal Background Check System (NICS) | |
Abstract:
To allow access to the NICS Indices in response to ATF inquiries in connection with civil or criminal law enforcement activity relating to the Federal explosives laws. Also, to add a new limited access to the FBI-maintained NICS Indices to provide information (when allowed by applicable federal and state laws) to a criminal justice agency or an authorized agency (as identified in the Security Clearance Information Act, codified in 5 U.S.C. 9101), conducting background checks during the hiring process, certification process, or reinvestigation of a person who will carry firearms in the performance of their official duties with the criminal justice agency or authorized agency, as applicable. This amendment will assist criminal justice agencies and other authorized agencies to know whether such person is or would be prevented from carrying firearms as a part of their official duties. |
