Abstract:
The Department of Justice and the Department of Homeland Security ("the Departments") are proposing to amend their respective regulations governing asylum eligibility. First, the Departments propose to modify the regulations regarding the burden of proof to codify standards pursuant to case law and statute. Second, the Departments propose to modify the regulations regarding the persecutor bar to include provisions addressing duress, lack of knowledge, and general principles. |
