Title: Employment of Workers With Disabilities Under Section 14(c) of the Fair Labor Standards Act | |
Abstract:
Section 14(c) of the Fair Labor Standards Act authorizes employers, after receiving a certificate from the Wage and Hour Division, to pay wages less than the federal minimum wage to workers who have disabilities for the work being performed. On September 26, 2023, the Department announced it would conduct a comprehensive review of the section 14(c) program. As part of this review, in October and November 2023, the Department held a series of stakeholder engagement sessions with other agencies, organizations, advocates, families, workers with disabilities, and service providers to listen to their experiences with section 14(c). Approximately 2,000 individuals participated in these sessions. The Department continues to review the regulations and consider input from stakeholders to determine appropriate regulatory actions. |
