Abstract:
The current regulations governing how the Office of Workers’ Compensation Programs (OWCP) administers the Energy Employees Occupational Illness Compensation Program Act of 2000, as amended (EEOICPA), 42 U.S.C. 7384 et seq., were last updated on February 8, 2019. On December 22, 2023, the National Defense Authorization Act for Fiscal Year 2024 was enacted as Public Law 118-31. Section 5501(b) of that statute amended section 7384l(8)(A) of EEOICPA to provide that beryllium sensitivity under Part B can now also be established by submitting three borderline beryllium lymphocyte proliferation tests performed on blood cells over a period of three years. This rulemaking updates multiple sections of the current regulations to incorporate this new entitlement provision |
