Title: ●Consideration of Duress When Applying the Persecutor Bars | |
Abstract:
The Department of Justice and the Department of Homeland Security ("the Departments") are proposing to amend their regulations governing eligibility for asylum and other immigration benefits and forms of relief. First, the Departments propose to modify the regulations regarding the burden of proof to codify standards pursuant to case law and statute. Second, the Departments propose to modify the regulations regarding the persecutor bar to include general principles and provisions addressing duress. |
