Title: Adjudication and Civil Penalty Procedures Under the Energy Policy and Conservation Act | |
Abstract:
Section 6303 of Title 42 of the United States Code provides for an on-the-record hearing for parties issued a civil penalty notice by the United States Department of Energy (DOE) for violations of 42 U.S.C. 6302. Through a direct final rule, DOE intends to adopt regulations that establish the procedure for such hearings, the rights and obligations of the parties and presiding authorities, and the procedures for issuing civil penalty orders under 42 U.S.C. 6303. On September 26, 2022, DOE published those procedures on its website at the URL provided. On September 30, 2022, DOE published in the Federal Register a Notice of Intent to commence on-the-record hearings before Administrative Law Judges pursuant to those procedures. (87 FR 59407). In the Notice of Intent, DOE also provided the URL for the hearing procedures. |
