Title: Updates to Other Transaction Authority for Technology Investment Agreements | |
Abstract:
This action is to establish a new part in 2 CFR by moving from 10 CFR 603 those sections that accurately reflect the statutory authorities at 42 U.S.C 7256(g) (otherwise known as other transactions authority) and deleting duplicative sections, unnecessary references to internal administrative actions and outdated references to other regulations. The information at 10 CFR 603 was promulgated in 2006 and requires the updates in this action to allow the Department of Energy (DOE) to utilize all the authorities granted by 42 U.S.C. 7256(g). Over time, the inclusion of internal administrative procedures has hampered DOE as the agency has grown and now has a broader mandate to demonstrate and deploy clean energy technologies while reaching non-traditional entities to meet its mission. The links to other regulations created confusion and limits not in accordance with the statutory authorities. By moving the other transaction regulations from 10 CFR 603 to 2 CFR 930, DOE removes the financial assistance references as part of the definition of other transactions so this authority can be used more broadly as envisioned in the Energy Policy Act of 2005. |
