Title: San Joaquin Valley PM2.5 Contingency Measures Federal Implementation Plan | |
Abstract:
By September 30, 2024, EPA has a consent decree deadline to finalize a Federal Implementation Plan (FIP) to meet the contingency measure requirement of the Clean Air Act for the San Joaquin Valley nonattainment area for the 1997, 2006, and 2012 PM2.5 national ambient air quality standards (NAAQS), unless the state submits and EPA approves a state implementation plan (SIP) submission meeting the CM requirements at issue prior to that date. (Comite Progreso de Lamont v. EPA, N.D. Cal, 21-cv-08733). EPA’s obligation to issue a FIP is based on EPA’s determination on December 6, 2018 (83 FR 62720) that the State of California failed to submit SIP revisions addressing certain nonattainment plan requirements (including contingency measures) for the San Joaquin Valley for these three PM2.5 NAAQS. EPA’s FIP was due January 7, 2021. EPA proposed the CM FIP on August 8, 2023 (88 FR 53431) and proposed action on a CM SIP on December 20, 2023 (88 FR 87988). |
