Title: Integrating e-Manifest With Exports and Other Manifest-Related Reports, PCB Manifest Amendments, and Technical Corrections | |
Abstract:
EPA intends to promulgate a third e-Manifest final rule. EPA published a notice of proposed rulemaking (NPRM) on April 1, 2022, which proposed certain amendments to the electronic manifest (e-Manifest) regulations concerning the e-Manifest program and system. Specifically, the NPRM proposed changes to manifest regulations for shipments of hazardous waste that are exported for treatment, storage, and disposal. EPA also proposed regulatory changes to the Resource Conservation and Recovery Act (RCRA) hazardous waste export and import shipment international movement document-related requirements to more closely link the manifest data with the international movement document data. In addition, EPA proposed regulatory amendments to three manifest-related reports (i.e., discrepancy, exception, and unmanifested waste reports) and requested public comment on changes to the manifest form. EPA also requested public comment with respect to how the Agency can begin to integrate biennial reporting requirements with e-Manifest data. Additionally, EPA proposed conforming regulatory changes to the Toxic Substances Control Act (TSCA) manifest regulations for polychlorinated biphenyls (PCB) wastes. Finally, EPA proposed to make technical corrections to fix typographical errors in the e-Manifest and movement document regulations. The comment period for the NPRM ended on August 1, 2022. The final rule will consider public comments to the proposals discussed in the NPRM. EPA has engaged certain industry and state stakeholders, including engagement with trade associations that work with interested or affected parties, on aspects of the rulemaking through webinars, public meetings and the Hazardous Waste e-Manifest System Advisory Board meetings. EPA plans to continue its outreach efforts with affected parties. |
