Title: First Responder Fair RETIRE Act | |
Abstract:
The Office of Personnel Management (OPM) is proposing to amend 5 CFR parts 831 and 842 to reflect the provisions enacted under the First Responder Fair Return for Employees on Their Initial Retirement Earned Act, Pub. L. 117-225, 136 Stat. 2293 (2022) (First Responder Fair RETIRE Act). The First Responder Fair RETIRE Act made significant changes to the retirement benefits of certain Federal employees serving as first responders who are subsequently injured or taken ill in the line of duty. The Act allows these affected individuals to maintain their enhanced retirement benefits upon returning to work in any position, whereas in the past they would not have maintained their enhanced retirement benefits unless they were able to return to a position subject to enhanced retirement provisions. Successful implementation of these new regulations will necessitate cooperation between OPM, the agency from which the affected individual is retiring, and the Department of Labor’s Office of Workers’ Compensation Programs. |
