Abstract:

The Office of Personnel Management (OPM) is proposing to amend its regulations issued under the Fair Labor Standards Act of 1938, as amended (FLSA). The purpose of this amendment is to update and harmonize OPM’s FLSA regulations with certain changes made by the Department of Labor (DOL), Wage and Hour Division, at 29 CFR part 541, in a recent rulemaking titled "Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees." OPM proposes to update the salary-based non-exemption level, increasing it to the annual rate of basic pay of $58,656, in order to ensure that the FLSA's intended overtime protections are fully implemented, and to simplify the identification of nonexempt employees, thus making the exemption easier for agency employers and employees to understand.
