Title: Regulatory Amendment to Clarify Timing of Haul Designation for Trawl Catcher Processors in the Gulf of Alaska and Bering Sea and Aleutian Islands Groundfish Fisheries | |
Abstract:
This action is a technical correction that is intended to clarify when trawl catcher processors (C/Ps) need to designate hauls to specific management programs, such as Community Development Programs (CDQ) or other management programs, by adding specific timing requirements. Under current regulations at 50 CFR 679.5(c)(4)(ii)(B), the timing of when a trawl C/P haul should be designated to management programs other than CDQ is clear, but the timing for designation to the CDQ program is unclear. This action would remove any ambiguity as to when a haul should be designated to the CDQ program versus other management programs and would align regulations across management programs to apply the same timing limitation for when a haul is required to be designated to a specific management program. This technical correction was requested by the North Pacific Fisheries Management Council in April 2019 and is supported by industry. Additionally, based on the scope of this action, impacts to small, directly regulated entities are expected to be minimal and beneficial for all participants. This action is not expected to place any new regulatory burden on participants and would only result in a change in reporting timing. This action is authorized under section 305(d) of the Magnuson-Stevens Act. |
