Title: Clean Water Act Section 401 Water Quality Certification For Department of the Army Permits | |
Abstract:
Department of the Army permits that authorize activities that may result in a discharge into waters of the United States require water quality certification under section 401 of the Clean Water Act. The U.S. Army Corps of Engineers' (Corps') regulations for water quality certification for the Department of the Army permits are found in various places throughout the Corps' regulations. On September 27, 2023, the Environmental Protection Agency (EPA) finalized its 2023 Clean Water Act Section 401 Water Quality Certification Improvement Rule. This rule went into effect on November 27, 2023. The Corps is proposing to amend its regulations for the Regulatory Program to ensure consistency with the EPA 2023 rule. |
