Title: Implementation of the USA Patriot Improvement and Reauthorization Act of 2005 Regarding Trafficking in Contraband Cigarettes or Smokeless Tobacco | |
Abstract:
The final rule would amend the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to implement provisions of Public Law 109-177, the USA Patriot Improvement and Reauthorization Act of 2005 regarding trafficking in contraband cigarettes or smokeless tobacco. Section 121 of the Patriot Act contained several amendments to the Contraband Cigarette Trafficking Act, 18 (CCTA), U.S.C. chapter 114, including reducing the threshold amount of cigarettes necessary to trigger jurisdiction under the CCTA from 60,000 to 10,000; extending the provisions of the CCTA to cover contraband smokeless tobacco; and imposing reporting requirements on persons, except tribal governments, who engage in delivery sales of more than 10,000 cigarettes or 500 single-unit consumer sized cans or packages of smokeless tobacco in a single month. The final rule would make ATF's regulations consistent with the existing statutory provisions. |
