DOL/ETA RIN: 1205-AC17 Publication ID: Fall 2024
Title: Worker Adjustment and Retraining Notification; Amendments for Clarifications
Abstract:

The Department of Labor’s (Department) Employment and Training Administration (ETA) is considering updating the regulations at 20 CFR part 639 to clarify the application of single site of employment as it relates to remote workers under the Worker Adjustment and Retraining Notification (WARN) Act. Specifically, this proposed rule will clarify that remote workers meet the definition of out-stationed employees under the WARN Act regulations. This clarification is in response to inquiries from the general public, employers, and workers possibly affected. Given the current prevalence of remote work, this clarification is necessary to make clear that formal WARN notification applies to remote workers.
