Title: Provider Nondiscrimination Requirements for Group Health Plans and Health Insurance Issuers in the Group and Individual Markets 
Abstract:

This proposed rule would implement section 108 of the No Surprises Act. Section 108 of Title I (the No Surprises Act) of Division BB of the Consolidated Appropriations Act, 2021 requires the Departments of Labor, Health and Human Services and Treasury to issue a proposed rule implementing Public Health Service Act (PHS Act) section 2706(a) as added by section 1201 of the Affordable Care Act. This proposed rule would implement provider nondiscrimination requirements for group health plans and health insurance issuers under PHS Act section 2706(a), which is incorporated by reference in section 715 of the Employee Retirement Income Security Act and section 9815 of the Internal Revenue.
