Title: Entry of Low-Value Shipments | |
Abstract:
This document proposes amendments to the U.S. Customs and Border Protection (CBP) regulations pertaining to the entry of certain low-value shipments not exceeding $800 that are eligible for an administrative exemption from duty and tax. Specifically, CBP proposes to create a new process for entering low-value shipments, allowing CBP to target high-risk shipments more effectively, including those containing synthetic opioids such as fentanyl. This document also proposes to revise the current process for entering low-value shipments to require additional data elements that would assist CBP in verifying eligibility for duty- and tax-free entry of low-value shipments and bona-fide gifts. |

Additional Information: CBP engages the public through multiple avenues. For example, the Commercial Customs Operations Advisory Committee (COAC) is a Federal Advisory Committee whose quarterly meetings are open to the public. The COAC provides advice to the Secretary of the Department of Homeland Security, the Secretary of the Department of the Treasury (Treasury), and the Commissioner of U.S. Customs and Border Protection (CBP) on matters pertaining to the commercial operations of CBP and related functions within the Department of Homeland Security and Treasury. The public may provide comments/input during the meeting. In development of this proposed rule, CBP consulted with the full COAC, as well as specialized working groups like the e-Commerce task force. In support of this effort, CBP has been conducting a voluntary test since 2019 to allow participants to enter certain low-value shipments, including those shipments subject to Partner Government Agency (PGA) data requirements, by filing a new type of informal entry (Entry Type 86) electronically in the Automated Commercial Environment (ACE). Further, CBP hosts the Trade Facilitation and Cargo Summits (TFCS) on a yearly basis which features CBP personnel, members of the trade community, and members of other government agencies in panel discussions on CBP's role in international trade initiatives and programs. The TFCS is open to the public and had discussed issues related to low-value shipments. | |
