Title: Family Unity Principles | |
Abstract:
The Department of Homeland Security (DHS) proposes regulations promoting family unity principles: defining what constitutes a separation of a family encountered at a U.S. border, U.S. Border Patrol checkpoint, or port-of-entry; detailing the limited circumstances when DHS may separate parents or legal guardians from their minor child(ren); and establishing when DHS must facilitate a separated family’s reunification. DHS proposes to codify current standards arising from Federal court litigation and current agency policies governing DHS family separation and reunification decisions. DHS also proposes to establish specific tracking, recordkeeping, and information-sharing requirements related to certain families, when appropriate and legally permissible. |
