Title: Automated Commercial Environment (ACE) Electronic Export Manifest For Vessel Cargo | |
Abstract:
U.S. Customs and Border Protection (CBP) proposes to amend its regulations to require the advance submission of electronic export manifest (EEM) information to CBP in the Automated Commercial Environment for cargo transported by vessel departing the United States. The proposed rule would identify the parties eligible to transmit advance vessel EEM information, and their responsibilities, and describe the time frames for transmission of the information prior to cargo loading or conveyance departure. Requiring this data in advance would significantly improve cargo safety and security while minimizing disruption to the flow of commerce in the sea environment. |

Additional Information: CBP has for many years, at least since 2015, maintained public engagement on multiple avenues either continuously, quarterly, or on a biannual or yearly basis. The Commercial Customs Operations Advisory Committee (COAC) is a Federal Advisory Committee that meets quarterly. The COAC provides advice to the Secretary of the Department of Homeland Security, the Secretary of the Department of the Treasury, and the Commissioner of U.S. Customs and Border Protection (CBP) on matters pertaining to the commercial operations of CBP and related functions within the Department of Homeland Security and the Department of the Treasury. The meetings are open to the public either in person or virtually. There are opportunities for a public comment period after each subcommittee update during the meeting. One of the COAC working groups is the Export Modernization Working Group (EMWG). This working group is specifically focused on the effects of progressive filing by the shipper to continuously update export information on successive dates, rather than filing on a specific date. In support of this effort, CBP has been conducting voluntary pilot programs since 2015 to allow participants to submit export manifest data to CBP electronically at least 24 hours prior to loading of the cargo onto the vessel in preparation for departure from the United States. Further, CBP hosts the Trade Facilitation and Cargo Summits (TFCS) on a yearly basis. The TFCS Summit features CBP personnel, members of the trade community, and members of other government agencies in panel discussions on CBP's role in international trade initiatives and programs. Members of the international trade and transportation communities and other interested parties are encouraged to attend. One of the breakout sessions covered export modernization and automation. | |
