Title: Individuals With Disabilities Education Act | |
Abstract:
The Department intends to determine the final action after it conducts a review of public comments on its proposed rule. After this review is complete, the Department intends to determine the final action regarding the proposal to modify the parental consent requirement in 34 CFR 300.154(d)(2)(iv) before a local education agency or LEA accesses a child's or parent’s public benefits or insurance for the first time to pay for services identified on the child’s individualized education program (IEP) under IDEA Part B. The Department is working with the Department of Health and Human Services on better understanding and providing technical assistance and working with States, districts, and other partners to improve the implementation of billing Medicaid for school-based IDEA services. The Department, in collaboration with the United States Department of Health and Human Services, held listening sessions on school-based health services in April 2022. Representatives from national education and healthcare provider membership organizations, and school district leaders provided feedback on a variety of topics including IDEA’s parental consent requirement in 34 CFR 300.154(d)(2)(iv). |
