Title: National Emission Standards for Hazardous Air Pollutants: Stationary Combustion Turbines; Amendments
Abstract:

On March 9, 2020, EPA finalized the Risk and Technology Review (RTR) of the National Emission Standards for Hazardous Air Pollutants for Stationary Combustion Turbines (40 CFR part 63 subpart YYYY). EPA received a petition for reconsideration of the final RTR, which cited EPA’s decision not to set limits for unregulated HAP in light of the decision in Louisiana Environmental Action Network v. EPA, 955 F. 3d. (D.C. Cir. 2020). EPA granted the petition for reconsideration and will issue a proposed rule that will review existing emission standards for formaldehyde and other HAP from stationary combustion turbines. The EPA will also propose, in light of the decision in Louisiana Environmental Action Network v. EPA, 955 F. 3d. (D.C. Cir. 2020), to establish emission standards for stationary combustion turbines that are not currently subject to an emission standard under the Turbine NESHAP. The Turbine NESHAP applies to all stationary combustion turbines located at major sources of HAP.
