Title: Adoption of Accessibility Standard to Ensure That Multifamily Housing Covered by the Fair Housing Act is Accessible to Individuals With Disabilities (FR-6259) | |
Abstract:
The Fair Housing Act requires multifamily housing covered by the Act to be designed and constructed so it is accessible to and usable by individuals with disabilities. This Advanced Notice of Proposed Rulemaking (ANPR) will seek public comment on whether HUD should adopt a national accessibility standard for complying with the design and construction requirements of the Act and, if so, whether the adoption of a national standard for accessibility would be more effective and efficient in ensuring access for individuals with disabilities and less confusing for architects, engineers, owners, developers, and other design and construction professionals than the current regulatory approach of identifying numerous safe harbors. In developing this ANPR, HUD has received feedback from the accessible design and construction industry (architects, designers, etc.) and stakeholders who have expressed desire for greater harmonization across federal accessibility requirements. The ANPR will solicit industry input regarding whether and how HUD develops a rulemaking for a Fair Housing Act standard. |
