Title: Service of Process on the Federal Housing Finance Agency | |
Abstract:
The proposed rule would establish the procedure for serving FHFA with service of process. Service of process is a jurisdictional prerequisite to instituting a private action. A plaintiff’s failure to properly serve a defendant may result in dismissal of the lawsuit. The proposed rule is intended to assist the public by identifying the approved way to serve FHFA with process when FHFA is named in a lawsuit while also addressing FHFA’s due process rights to receive notice of pending litigation. The proposed rule would create a procedure that the public may follow to satisfactorily comply with the requirements of the United States Constitution to provide the required due process when seeking to assert claims against FHFA. |
