FWS will make a listing determination, based on the best available scientific and commercial data, for the spotted turtle (Clemmys guttata) under the Endangered Species Act. This turtle is found in Connecticut, Delaware, District of Columbia, Florida, Georgia, Illinois, Indiana, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Rhode Island, South Carolina, Vermont, Virginia, West Virginia, and Canada. If we determine that listing is warranted, we will also propose to designate critical habitat for the species, if prudent and determinable. This species status determination is included in a multi-species settlement agreement where the court requires completion of 12-month findings under section 4 of the Endangered Species Act for 76 species by the end of fiscal year 2029. The court order does not provide specific dates for each species but requires completion of a minimum number of actions in each fiscal year. This action counts toward the minimum required number of 12-month findings to comply with the court's order.
