Abstract:

This final rule adjusts the civil monetary penalty rates contained in OSMRE regulations implementing SMCRA. OSMRE issues this rule under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015.

Overall Description of Deadline: The 2015 Act requires Federal agencies promulgate rules to adjust the level of civil monetary penalties ("CMPs") to account for inflation. In addition, the 2015 Act also requires agencies to make subsequent annual adjustments for inflation by January 15 of each year.
