Regulatory and Deregulatory Actions Under Development

AGENCY: Pension Benefit Guaranty Corporation (PBGC).

ACTION: Semiannual regulatory agenda.

SUMMARY: This document reflects the regulatory/deregulatory actions of the Pension Benefit Guaranty Corporation (PBGC) over the next 12 months. Many of these actions are the result of PBGC's active retrospective regulatory review program to identify and ameliorate inconsistencies, inaccuracies, and requirements made irrelevant over time. All of these actions strive to promote clarity and reduce burden with the goal that net cost impact on the public is zero or less overall.

SUPPLEMENTARY INFORMATION: Under Executive Order 12866 on Regulatory Planning and Review, each agency is required to prepare an agenda of all regulations (as defined in section 3(d)) under development or review. The Regulatory Flexibility Act, Public Law 98‑354, 5 U.S.C. 601, has a similar agenda requirement. Under that law, the agenda must list any regulation that is likely to have a significant economic impact on a substantial number of small entities. Executive Order 13771 on Reducing Regulation and Controlling Regulatory Costs adds that unless otherwise required by law, or approved in advance by the Office of Management and Budget Director, an agency shall not issue a regulation if not included on the most recent version of the agenda.

The Office of Management and Budget has issued guidelines prescribing the form and content of the regulatory agenda. Under those guidelines, the agenda must list all regulatory and deregulatory activities being conducted or reviewed in the next 12 months and provide certain specified information on each regulation. The effect of this agenda is to advise the public of PBGC's current and future regulatory and deregulatory activities.
