This recordkeeping requirement is approved for three years, but should be discontinued after 1993. Currently EPA has difficulty enforcing determinations of hazardousness by generators under the "soft hammer" provisions of land disposal restrictions. Unless generators are required to retain records describing the origin and concentrations in the waste, EPA will have no means to judge whether the waste does or does not require treatment. The soft hammer provisions and capacity variances should end by 1994, thereby removing the need for this recordkeeping requirement. . An unusual five year retention period is approved for this collection because EPA requires additional time to enforce this program during its start up. Otherwise a three year retention period would be required.
