Abstract:
The Discharge Application: Total and Permanent Disability serves as the means by which an individual who is totally and permanently disabled, as defined in section 437(a) of the Higher Education Act of 1965, as amended, applies for discharge of his or her Direct Loan, FFEL, or Perkins loan program loans, or TEACH Grant service obligation. The form collects the information that is needed by the U.S. Department of Education (the Department) to determine the individual's eligibility for discharge based on total and permanent disability. The Department, through an Interim Final Rule, is amending the regulations for the Federal Direct Loan Program, the Federal Family Education Loan Program, and the Federal Perkins Loan Program to remove unintended administrative barriers for veterans who are entitled to a student loan discharge due to a service-related total and permanent disability and requesting a revision to the current information collection.

Short Statement:
We are reporting a total change in burden due to the decrease in the number of anticipated respondents at 221,629 and the estimated burden hours at 110,814 hours based on the change in the requirement for veterans and qualifying SSA recipients who are no longer be required to submit the TPD form, in most cases. This is a total decrease of 10,000 anticipated veteran respondents and 23,171 qualifying SSA recipients and responses and a corresponding total decrease in 11,586 hours. The pre-approved Notice of Action dated 11-18-2020 incorporated the 10,000 veteran respondents/responses and 5,000 burden hours. The inclusion of qualifying SSA recipients removes an additional 23,171 respondents/responses and 11,586 burden hours. This change is due to regulatory changes in 674.61, 682.402, and 685.213. There are no changes to the form itself.
