Title: ●Civil Monetary Penalty Adjustments For Inflation  
Abstract:

In this final rule, the Department of Homeland Security (DHS) made the 2022 annual inflation adjustment to its civil monetary penalties. On November 2, 2015, the President signed into law the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (2015 Act). Pursuant to the 2015 Act, all agencies must adjust civil monetary penalties annually and publish the adjustment in the Federal Register no later than January 15th. Accordingly, this final rule adjusted the DHS civil monetary penalties for 2022 pursuant to the 2015 Act and The Executive Office of the President (EOP) Office of Management and Business (OMB) guidance. The new penalties will be effective for penalties assessed after this final rule's publication in the Federal Register whose associated violations occurred after November 2, 2015.
