THIS FORM IS REQUIRED TO ESTABLISH A CLAIM FOR BENEFITS BASED ON THE UNEXPLAINED ABSENCE OF ANY INDIVIDUAL. SINCE NO STATE LAW PROVIDE FOR PRESUMPTION OF DEATH IS APPLICABLE TO CLAIMS FOR VA BENEFITS, IT IS NECESSARY THAT WE GATHER SUFFICIENT INFORMATION CONCERNING THE DISAPPEARANCE OF THE INDIVIDUAL TO PROPERLY MAKE A DECISION. AUTHORITY IS 38 U.S.C. 108.
