Abstract:
THE REGS. REQUIRE AN S CORPORATION THAT HAS A CAPITAL GAIN SUBJECT TO TAX UNDER SEC. 1374 TO ATTACH A FORM 1120 (I.E., A C CORPORATION TAX RETURN) TO ITS RETURN FOR TAXABLE YEAR BECAUSE THE TERM "TAXABLE INCOM IN SECTION 1374 (D) IS DEFINED TO MEAN THE TAXABLE INCOME OF THE CORPORATION IF IT WERE A C CORPORATION WITH CERTAIN EXCEPTIONS. THE REGS. ALSO PRESCRIBE A PROCEDURE FOR REQUESTING A WAIVER OF THE TAX IMPOSED BY SECTION 1375 IN CERTAIN CASES.
