WE HAVE CLEARED THIS COLLECTION OF INFORMATION FOR THREE YEARS, THE MAXIMUM PERIOD ALLOWED BY THE PAPERWORK REDUCTION ACT. WE AGREE WITH THE FIRST YEAR BURDEN ESTIMATE OF 227,427 HOURS. HOWEVER, THE AGENCY HAS STATED ITS INTENTION OF REDUCING SUBSEQUENT YEAR BURDEN ESTIMATES BY THE BURDEN INCURRED BY STATE-PLAN STATES. ACCORDING TO 5 CFR 1320.7(B)(2), A COLLECTION OF INFORMATION SPONSORED BY A FEDERAL AGENCY THAT IS ALSO SPONSORED BY A UNIT OF STATE OR LOCAL GOVERNMENT IS PRESUMED TO IMPOSE A FEDERAL BURDEN EXCEPT TO THE EXTENT THAT THE AGENCY SHOWS THAT SUCH STATE OR LOCAL REQUIREMENT WOULD BE IMPOSED EVEN IN THE ABSENCE OF A FEDERAL REQUIREMENT. A REDUCTION IN OSHA'S BURDEN ESTIMATES FOR SUBSEQUENT YEARS MUST BE COMPLETELY SUPPORTED BY EVIDENCE THAT THE STATE-PLAN STATES WOULD HAVE IMPOSED SUCH BURDEN EVEN IN THE ABSENCE OF A FEDERAL ASBESTOS REGULATION.

Abstract:
THIS REGULATION REQUIRES EMPLOYERS TO TRAIN EMPLOYEES ABOUT THE HAZARDS OF ASBESTOS, TO MONITOR EMPLOYEE EXPOSURE, TO PROVIDE MEDICAL SURVEILLANCE AND TO ESTABLISH AND MAINTAIN ACCURATE RECORDS OF EMPLOYEE EXPOSURE TO ASBESTOS. THE STANDARD APPLIES TO EMPLOYERS IN GENERAL INDUSTRY AND THE MARITIME INDUSTRIES.
