We remain unconvinced that question 5 has public utility to the agency The statutory references to which the agency points are meant to punis payees who have committed fraud in order to receive these funds. We ha discovered no reference which prohibits any person who has committed any other felony (other than those acts listed at 42 USC 408 and 42 USC 1383) from becoming a payee. We therefore do not approve use of question 5 in its present form. All other questions are approved, and the agency may wish to resubmit a re-phrased version of question 5 if it wishes.

IF A BENEFICIARY IS INCAPABLE OF HANDLING HIS/HERS OWN AFFAIRS, THE LEGAL GUARDIAN OR OTHER RESPONSIBLE PARTY MAY APPLY TO RECEIVE THE BENEFITS ON BEHALF OF THE BENEFICIARY AS A REPRESENTATIVE PAYEE. THE CM-910 IS THE FORM THE POTENTIAL REPRESENTATIVE PAYEE MUST SUBMIT TO DCMWC'S STAFF FOR REVIEW TO DETERMINE IF THE REQUEST CAN BE APPROVED.

On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
The following is a summary of the topics, regarding the proposed collection of information, that the certification covers:
