This ICR for the proposed radionuclides drinking water regulations is not approved. For approval of an information collection request 5 CFR Part 1320.4 (b)(1) requires the agency to demonstrate that the collection of information is the least burdensome necessary for the proper performance of the agency's functions to comply with legal requirements and achieve program objectives." EPA has not sufficientl demonstrated that monitoring requirements for radon is the least burdensome approach possible. EPA must demonstrate why monitoring for radon should be more frequent (four times in base year) than monitoring for other radionuclides (one in base year). In the final ICR, EPA should report studies on variability of radon levels over a one year period. This information would be useful in determining whether requiring multiple radon samples in one year is excessive. EPA should also consider allowing systems the flexibility of monitorin more frequently than currently required if a system feels that its monitoring plan provides a better esimate of the average radionuclide contaminant level.

UNDER THESE REGULATIONS STATE AND LOCAL RESPONDENTS WILL COLLECT AND REPORT INFORMATION ON A QUARTERLY AND ANNUAL BASIS. THE EPA, THROUGH THE FEDERAL REPORTING DATA SYSTEM, USES THE INFORMATION TO ENSURE COMPLIANCE WITH THESE REGULATIONS AND TO PROTECT PUBLIC HEALTH.
