Abstract:
THE ENDANGERED SPECIES ACT IMPOSED, WITH CERTAIN EXCEPTIONS, PROHIBITIONS AGAINST THE TAKING OF ENDANGERED SPECIES. SECTION 10 ALLOWS CITIZENS TO INCIDENTALLY TAKE LISTED SPECIES IF THEY APPLY FOR GENERAL PERMIT AND/OR CERTIFICATE OF INCLUSION. WITHOUT THE PERMIT, TAKINGS ARE PROHIBITED AND CITIZENS ARE SUBJECT TO PROSECUTION THEREUNDER.
