This ICR for test rule program under TSCA Section 4 is approved. EPA should report annually to OMB the total annual burden from the test rules and consent orders issued. OMB reserves the authority to review under the Paperwork Reduction Act any highly unusual testing requirements but expects to conduct separate reviews rarely, if at all EPA has done a good job explaining the methodology for calculating testing burden from laboratory testing costs.

RULES AND CONSENT ORDERS UNDER TSCA, SECTION 4, REQUIRE THAT ONE MANUFACTURER OR PROCESSOR OF THE SUBJECT CHEMICAL PERFORM SPECIFIED TESTING SO THAT THE EFFECT OF MANUFACTURING, PROCESSING, DISTRIBUTION, USE, AND DISPOSAL OF THE CHEMICAL ON HUMAN HEALTH AND THE ENVIRONMENT CAN BE REASONABLY PREDICTED OR DETERMINED. TSCA SECTION 4 ALLOWS MANUFACTURERS OF A CHEMICAL SUBJECT TO A TEST RULE TO EITHER PERFORM
