OMB does not approve this information collection request contained in ED's Ability-to-Benefit testing NPRM, and continues the current clearance of the forms used in the ATB testing process. ED's proposed rule sought comment on a variety of issues relating to the potential burden involved in this collection, which may not meet the PRA standar regarding imposition of minimal burden to achieve the agency's goals; this includes burden involved in the proposed requirement that Title I schools collect a high school diploma from every student receiving Title IV aid. In addition, ED requested comment on an alternative approach to implementing the ability-to-benefit testing requirements o the HEA, which if implemented may reduce burden substantially. ED sha address these issues in responding to comments in the preamble of its final rule on ATB testing, and in the PRA clearance package associated with that final rule.
