This is a major rulemaking that will go through a series of comment periods before being finalized. In addition to the collections proposed in the NPRM and the supporting statement, the FCC has permission to either collect or require third party notifications to fulfill intent of Section 251(f) of the Telecommunications Act of 1996. OMB strongly encourages the FCC to use existing Commission and State processes to oversee the pole attachement\right-of-way access provisions of the Act, unless there is evidence that these have not or will not be effective. OMB recommends that the FCC work with incumbent local exchange carriers and potential competitors to develop mechanisms to inform consumers on how they can learn about the alternative providers in their area and the process they need to follow in order to change carriers. OMB also recommends that the FCC use existing industry processes as much as possible to to meet the technical change and network disclosure requirements. In subsequent rulemakings, the FCC should attempt to clarify what constitutes the minimum burden of proof for interconnection, unbundling, collocation, and right-of-way requirement waivers. Finally, this collection covers FCC requirements for sharing or providing all signal information/data needed to support interconnection, transmission, routing, advanced call processing features, and other technical aspects covered under FCC CC Docket Rulemaking 96-98.
