This collection contains proposals requiring telecommunications providers participating in an interception activity to file an affadavit; companies to keep records on these activities; lists of designated company employees allowed to effectuate lawful intercepts; submission of company security and recordkeeping procedures to the FCC for review. This collection does not cover any requirements regarding investigations of employee backgrounds in order to determine their suitability to participate in these activities. Since this is a very controversial rulemaking, and OMB has not received specific comments related to the proposed information collection requirements, OMB approves this collection with the understanding that the FCC rulemaking process may address issues raised by industry comments. This collection also proposes to implement CALEA Sections 107 and 109(b) -- but the FCC has not finalized their implementing rules and thus did not include estimates of the burden associated with these requirements in this collection.
