Terms of Clearance:
This information collection is approved subject to the following term of clearance: 1. OMB recognizes that the revision to this ICR is narrow in scope in order to comply with statutory obligations. This revision is for less than three years, so OMB is allowing the pre-existing terms of clearance to continue. Therefore, in the resubmission of this ICR, the FBI must provide the FCC with justification for the requirement that all carriers maintain copies of the CPNI of all US-based customers, regardless of wheth er they are U.S. domestic customers. Additionally, the FBI should provide specifical information regarding the CPNI content that they would dem to be acceptable for FBI purposes. The FCC shall use this information to identify costs and hour burden for companies to create and store this information and provide an indication as to the number of affected entities that do not retain all of this information as part of their current business practices. Finally, the FCC should explicitly state that release of CPNI to law enforcement agencies, including the FBI, is pursuant to lawful authority (i.e., court order, warrant, or subpoena.)

Abstract:
The attached Third Report and Order clarifies and particularizes the statutory obligations of section 222 of the Telecommunications Act of 1996. Among other things, all telecommunications common carriers must provide subscriber list information gathered in their capacity as providers of telephone exchange service to any person upon request for the purpose of publishing directories. Carriers are obligated to provide updated subscriber list information and notices of changes in subscriber list information to the extent those changes reflect a customer's decision to cease having a telephone number listed.
