Terms of Clearance: This ICR is approved pursuant to 5 CFR 1320. When EPA submits this ICR for renewal, it must evaluate, after consulting with respondents, the burden estimates for reporting and recordkeeping requirements. In its resubmission, EPA should list the names, phone numbers, and affiliations of the respondents it contacted. In the supporting statement for the renewal, EPA must ensure that all data and assumptions underlying its estimates of labor costs (including loading rates) and burden hours (by task) are described fully and are up to date. EPA should specifically re-evaluate its overhead loading rate assumptions, to ensure that they are consistent with industry practices and current EPA and OMB guidance.

Abstract: This ICR would renew the current ICR for the Facility Response Plan (FRP) requlation, 40 CFR Part 112, for non-transportation- related facilities that handle, store, transport oils. The FRP rule which was promulgated under section 311(j) of the Clean Water Act, as amended by OPA, applies only to high risk facilities that transfer large volumes of oil over water, or store one million gallons or more of oil, and meet additional criteria. The ICR includes EPA ICR 1630.06, which applies to facilities that handle, store, or transport animal fats or vegetable oils, which has been previously approved by OMB.
